What is a public liability claim?
When visiting public property or land, the person or organisation responsible for the premises has an obligation to ensure it is safe. If this is not the case and someone injures themselves then there is a case for a claim.
I feel bad making a claim
It is quite normal to have reservations about making a public liability claim but the reality is that the person or organisation responsible for the premises should have public liability insurance to cover such events. If you have hurt yourself and suffered pain, personal expense, or any other negative factor associated with the injury then it is only fair that you are compensated for this.

Tips for a successful public liability claim
There are a number of measures you can take to improve your chances of claiming compensation for your injury and any associated financial loss.
To be successful you need to prove on the balance of probabilities that the fault lies with those responsible for taking care of the premises or other area in their control such as a road or pathway. Don’t worry, we will help you do this but there are a few things that will support your case if you can get them:
- Photos of the scene of the accident in as much detail as you can
- If the accident happened as a result of a pothole in the pavement or road then it makes sense to put a coin (or other obvious object) next to the pothole as you photograph it to give the viewer a sense of scale.
- Witnesses – get names and contact details of anyone who witnessed the incident.
- Inform a member of staff if applicable and ensure a record is made in the accident book with date and time detail.
- Ensure you keep any receipts for travel to and from the hospital, doctors or chemists; prescription receipts and any other expenses incurred as a result of the accident.
