Slippery decking causes painful knee injury

In December 2015, Mrs B was enjoying a short hotel break when she slipped on poorly maintained decking and injured her knee. Mrs B sustained a soft tissue injury to her knee together with the acceleration of a pre-existing arthritis condition. Following a call to the National Accident Helpline, Mrs B was transferred to Russell Worth Solicitors and we were happy to represent her in a claim against the hotel. A formal claim was lodged against the hotel and whilst we awaited their response it was arranged for Mrs B to attend an independent medical expert who carried out an examination and prepared a report on her behalf. The report was supportive of Mrs B’s claim and linked the injuries to the accident. It was the expert’s opinion that due to the accident, Mrs B would require a full knee replacement some 2 years earlier than she would have had the accident not occurred. After making their investigations, the insurance company for the hotel admitted responsibility for the accident and negotiations began to agree settlement. Following our advice, Mrs B accepted the sum of £12,658 in settlement of her claim which included an amount for both her injuries and her financial losses. Commenting on the case Mrs B said the following: “A nasty accident with a good ending. I used Russell Worth after having an accident on holiday. They were professional but in a way that I was a person not just a claim number. My representative kept me up to date on every process. It was a one to one situation and you felt she really cared. I was guided well and we got a good result. Hopefully I won't have anymore accidents !!!!! But I would definitely contact Russell Worth again and recommend them to everyone.”

Slip in Sainsburys causes painful back injury

Mrs M called the National Accident Helpline on 27th June 2016 after slipping on a wet floor in Sainsbury's and injuring her back. National Accident Helpline transferred Mrs M to Russell Worth who were happy to represent her in a personal injury claim. Wasting no time, within two days of receiving Mrs M’s instructions, RL, public liability specialist here at the office, notified Sainsburys’ insurance company of the claim. Whilst awaiting the insurance company’s response, RL arranged for Mrs M to visit an independent medical expert who prepared a report on her behalf outlining her injuries and linking them to the accident. The expert was also able to ensure that any future needs Mrs M may have would be identified. Fortunately the expert was of the opinion that Mrs M would recover fully from her injuries. Sainsburys’ insurance company admitted responsibility for the accident and RL negotiated with them to ensure Mrs M received the highest settlement possible for her injuries and additional expenses incurred as a direct result of the accident. Following RL's advice, Mrs M accepted the sum of £3,814 for her pain and suffering which included a sum for medical expenses and travel costs. Commenting on the case, Mrs Msaid the following: “Brilliant company. They sorted out my claim very quickly. Very helpful. Would use again and highly recommend to anyone.”

Motorway road traffic accident causes whiplash injury

Travelling along the motorway, as a passenger in a colleague’s car, Rwas involved in an accident following the car being knocked by a HGV. R sustained whiplash injuries to his neck and shoulders and required physiotherapy treatment. JT, road traffic accident specialist here at Russell Worth, took on the claim for R in which was not straight forward to begin with. There were limited details for the HGV vehicle and initially JT made a claim with the Motor Insurer’s Bureau (MIB) who deal with untraced and uninsured vehicles.  The MIB were able to trace the incident, vehicle and third party insurance details which was great as a claim could then be made direct to the insurance company for the HGV vehicle. It was arranged for R to attend an independent Medical Expert who assessed R injuries, gave a prognosis and was able to ensure that there were no future medical needs which needed to be taken into consideration when settling the claim. After some negotiation, the insurance company agreed to award R the sum of £2,385 for his pain and suffering which included £285 to cover physiotherapy fees. Commenting on the case R said the following: - ‘Excellent.  JT was superb. Her communication was purposeful, concise, friendly and professional. A real credit to herself and the firm.’
