Slip in local supermarket whilst shopping causes injury

On 9th June 2015, S was shopping in her local supermarket when she slipped on a spillage on the floor and sustained a whiplash type injury together with soft tissue damage to her knee. There were no warning in signs in place and it later transpired there was not a sufficient cleaning system in place either. JC, public liability specialist here at Russell Worth, represented S in a claim against the supermarket for the pain, suffering and loss she had sustained as a result of the accident. On 8th July 2015, JC notified the supermarket’s insurers of the claim and within seven weeks they had responded, admitting they were responsible for the accident. Together with the admission, the supermarket’s insurers offered to compensate S in the sum of £1500 prior to a medical report being obtained. JC advised S that without a medical report it would be impossible to put a value on her injuries as it was impossible to say how long they would be likely to last and how they may impact on her in the future. The initial offer was rejected and JC arranged for S to meet with an independent medical expert on 12th November who prepared a report outlining his advice. As S’s injuries were ongoing at that point, the expert advised her to re-attend in 12 months by which time a prognosis would hopefully be easier to establish. S agreed to this and in the meantime JC arranged for an interim payment of £1,000 to be paid to S which was agreed by the supermarket’s insurers. Midway through August 2016, S contacted JC to advise she had fully recovered and required no further treatment. Given there was no longer a need for S to attend the medical expert for a second time, JC was able to begin negotiations with the supermarket’s insurers to settle the claim in full. After some negotiation, S accepted the sum of £3,823 in full and final settlement of her claim which included a sum to cover her medical and travel expenses incurred as a result of the injury. Nasty injury sustained following slip at ASDA

On 18th February 2016, Mrs X telephoned the National Accident Helpline following a slip at ASDA which resulted in her sustaining injury. The National Accident Helpline transferred Mrs X to Russell Worth and we were happy to represent her in a personal injury claim. Mrs X sustained soft tissue injuries to various parts of her body, including her hip, back, and elbow, together with a fracture to her right wrist. LP, public liability specialist here at Russell Worth, notified ASDA’s insurance company of Mrs X’s claim and Court proceedings were subsequently issued in order to put pressure on them to deal with the matter. Whilst waiting for a response from ASDA’s insurers, LP built Mrs X’s case and obtained medical evidence and witness statements to support her claim. Cyclist injured on roundabout

Mr D came through to Russell Worth in November 2015 following an accident in which, whilst on his bicycle, a car pulled out and blocked his right of way. Mr D was knocked off his bike and sustained both physical and psychological injuries. JT, road traffic accident specialist here at Russell Worth, represented Mr D in a claim for compensation. JT notified the insurance company for the third party who began investigating the matter. In the meantime JT arranged for Mr D to attend an independent Medical Expert who assessed his injuries and gave a timescale within which he expected a full recovery. The Medical Expert also recommended Mr D attend a course of physiotherapy to aid his recovery. Taking all injuries into consideration the Medical Expert anticipated Mr D to be fully recovered within 12 months. The insurance company for the other side agreed to award Mr D the sum of £4,990 for his pain and suffering which included £480 for physiotherapy fees. Road traffic accident causes travel anxiety

In December 2015, Mrs X approached Russell Worth after being involved in a road traffic accident. Mrs X was a passenger when the car she was in was hit from behind by another vehicle. BS, road traffic accident specialist here at Russell Worth, was happy to assist Mrs X in a claim for compensation as she has sustained a whiplash injury following the accident together with travel anxiety. BS arranged for Mrs X to attend an independent Medical Expert who assessed Mrs X and prepared a report on her behalf. In his report the Medical Expert assessed the whiplash injury would last for approximately 4 weeks and the travel anxiety 6 months.
