Fall into empty swimming pool leaves client injured
On 19th May 2014, Mr B was staying at a friend’s house when he fell into their empty swimming pool. It was very dark and Mr B had gone outside, alone, to have a cigarette. The pool and area surrounding were poorly lit and our client fell into the uncovered, empty pool and sustained a nasty back injury. The home owner denied responsibility for the accident throughout the claim and AH, occupier’s liability specialist here at Russell Worth, worked hard to secure Mr B a compensation settlement. AH issued Court proceedings against the home owner who then instructed his own solicitors to deal with proceedings on his behalf. AH also arranged for Mr B to attend an independent medical expert who, following examination, prepared a medical report supporting Mr B’s claim of his injuries being attributable to the accident. The case was difficult and there were many obstacles to overcome along the way. The advice of a Barrister was sought and negotiations began to try and settle the claim. In an attempt to avoid going to trial, the solicitors for the third party offered to settle the claim in the sum of £3,000. This offer, on AH’s advice, was accepted by Mr B. Five figure award for client who trips whilst out running
In October 2015, Mrs M was out running when she tripped and fell due to uneven paving. Upon attendance at hospital Mrs M was given an x ray of her arm and it was found she had sustained a nasty fracture to her wrist which required surgery. The surgery itself has left Mrs M with a significant scar and the recovery period was some 12 weeks. Being employed at the time, working as a teacher, Mrs M needed to take time off work following the accident which resulted in a loss of earnings. She also needed help with daily chores, personal care and childcare for several weeks following the accident which fortunately, family members were able to assist with. Road traffic accident leaves client injured and anxious
In August 2015 Mrs A was a passenger in a stationary car which was hit from behind by another vehicle. Bus passenger injured when thrown out of seat
Anyone who has been on a bus will know not to expect the smoothest ride but no one expects to be thrown out of their seat due to harsh braking by the driver. This is what happened to S in the summer of 2014 and the experience left her not only physically injured but also suffering from anxiety for some time.
