Fall on moss covered steps results in nasty injury
On 9th December 2014 Miss K was walking down the communal stairs where she was residing when she slipped on a build-up of moss and fell backwards. To try and break her fall, Miss K put her hands out and in doing so sustained a nasty soft tissue injury to both her wrists. Miss K approached Russell Worth and LH, public liability specialist, was happy to represent her in a claim for compensation. This involved approaching the landlord who was responsible for the steps and they in turn passed the claim to their insurance company to deal with. Although initially liability for the accident was denied by the insurance company LH pressed on and issued Court proceedings as she believed there were good prospects of the claim being successful if put before a Judge. LH also arranged for Miss K to meet with an independent medical expert who prepared a report on her injuries, linking them to the accident, and advising on a prognosis/future treatment requirements. After some time the insurance company offered to award Miss K the sum of £4,000 for her pain and suffering which included an award for additional losses such as travel to medical appointments and care. This often happens as although the landlord will not admit responsibility, the insurance company will not want to run the risk of losing at trial when their prospects of winning are low. Going to Court can be a very expensive exercise if you lose. LH advised Miss K that the offer of £4,000 was low and successfully managed to negotiate a higher award of £7,600 which Miss K was happy to accept. Trip on an uneven pavement leaves client with knee injury
On 6th December 2014, Mr X was walking along the pavement when he tripped on a raised paving slab and fell to the ground. Mr X fell onto his right knee which became bruised and swollen. Not long after the accident, Mr X approached Russell Worth Solicitors who arranged for photographs of the accident location to be taken over a six month period to firstly evidence the defect and secondly illustrate that the Council responsible had not inspected and repaired the defect as they should have. Mrs C was cycling along a road when she was struck by a car which overtook her, and which failed to leave sufficient room to both pass Mrs C and avoid an oncoming bus – a collision occurred and Mrs C was injured.
