Poorly maintained water slide in Spain causes broken leg to holiday maker

The Claimant, Mr M , whilst holidaying in Spain, sustained a broken leg. The hotel had various water play areas, one of which had a poorly maintained slide. Standing at the top of the slide he slipped due to the worn area and it having no slip resistance. Mr M took photographs of the area, therefore we could see the worn section of the top of the slide. These were a great asset to the evidence of the claim. Mr M attended hospital in Spain in relation to his broken leg. However, upon his return, it was clear Mr M was also suffering with a psychological injury including anxiety, mood disturbance and social withdrawal. The Defendant denied liability for the accident throughout the claim, as is common where the accident has occurred outside the UK. They were arguing the hotel was sufficiently maintained and the local standards, which apply to Spain, were not breached. We therefore instructed an expert to prepare a specialist report on the local standards. The expert confirmed there was a breach.  The Defendant will often deny any liability, so expert evidence is necessary. Without such a report it is likely the Defendant would have continued to defend the case to Trial. With the specialist expert report, Solicitor, SJ settled the claim for £16,000 which included an element of the Mr M costs of the holiday. Pothole causes jolting injury

Miss H was walking towards the entrance to her work, when she tripped over a large pothole. The pothole measured over 10cm deep. Miss H did not fall to the ground when she tripped but jolted her back. Unable to straighten her back or walk very far without pain Miss H sought medical attention from her local minor injuries unit. Following a prescription of strong painkillers for 5 weeks to help with the pain, a referral from her GP saw Miss H attending an Osteopath. In addition, we arranged physiotherapy to help Miss H's recovery. As a result of the trip Miss H suffered a sprain to muscles in her upper back and to joints in her lower back and pelvis region. Although Miss H returned to work after 7 weeks the residual effects were expected to last around 12-18 months. After the claim was submitted to the land owners an initial offer of £5500.00 was received. After deciding this offer was too low, counter offers were made and a settlement of £6200.00 was agreed. Successful conclusion to difficult injury claim

In January of 2014, Mr W was seriously injured whilst crossing the road and being hit by a car. Mr W sustained life changing injuries including multiple fractures to his spine and a brain injury. After being told by another firm of solicitors that they were unable to continue acting for him due to prospects of success being too low, Mr W approached Russell Worth Solicitors for help. Read end shunt causes psychological injury

In May 2016, Miss X was stationary in her car at a roundabout when a vehicle approaching from behind failed to stop and collided with the back of her car. As well as a mild whiplash injury, Miss X suffered a psychological injury following the accident in the form of anxiety. Being in no way to blame for the accident, and injured as a result of it, Miss X approached Russell Worth Solicitors for advice on making a personal injury claim. NG, road traffic accident specialist here at the office, represented Miss X and notified the other side’s insurance company of the claim. Whilst the other side were investigating the claim, NG arranged for Miss X to attend a medical expert so that evidence could be obtained to support her claim.
