Slippery tiles result in fall and injury
On Christmas Day 2014, Mr X was unfortunate enough to fall on slippery tiles outside a property where he had been visiting friends. Mr X sustained a broken thumb which needed surgery along with damaged tendons in his right shoulder. Not only was Mr X’s Christmas ruined but he faced a long recovery which necessitated time off work and loss of earnings. BW, public liability specialist here at Russell Worth, was keen to represent Mr X in a claim against the property management company responsible for the upkeep of the property and tiled area outside. BW arranged for a Slip Test Engineer to attend the premises and carry out testing on the tiles and a report followed. The report showed that the tiles, when wet or dirty through moss/debris, carried a high risk of slip over what is acceptable by current UK Guidelines. After some negotiation, the insurance company for the other side offered to award Mr X the sum of £3,000 for his suffering and other losses. BW advised Mr X that he thought this offer was far too low and advised to return with a counter offer. Mr X was happy to be guided by BW and eventually Mr X was awarded the sum of £9,500 which he was happy to accept and more in line with what could be expected for the injury sustained and his loss of earnings. Commenting on the case Mr X said: ‘Excellent. Very good service, polite, helpful and nothing was too much trouble. Couldn't have been happier with the service provided.’Free Claim Assessment
